A Hillsboro man is facing charges after allegedly causing damage to the area currently under construction for the Carl Smith Drive.

According to an affidavit filed with the Hillsboro Municipal Court, the Highland County Sheriff’s Office received a call from the roadway’s project manager on Thursday.

He reportedly “advised that overnight, an unknown motor vehicle illegally accessed the closed road from SR 73 and crashed in what he called the ‘round about,’” as stated in the affidavit.

The deputy reported that upon arrival at the scene, he located a bottom part of the vehicle that was left behind from the crash. He added that “significant damage to the ‘round about’ concrete berm was photographed as evidence,” according to the affidavit.

The affidavit added: “It was obvious to (the deputy) that the suspect vehicle had damage to a tire and rim.”

According to the affidavit, the deputy determined that the suspect vehicle had “left the scene traveling north on Careytown Road, turn(ed) east on Powell Road, (went) across SR 73, turn(ed) south on Mad River Road, (and) then (turned) into a private drive.”

At that residence, the deputy reportedly found the suspect vehicle. He spoke with the vehicle’s owner, who allegedly identified a relative – Wyatt Wagner, 22 – as “the person who had his truck,” the affidavit stated.

Wagner appeared for an arraignment in municipal court on Friday. Records show that he is charged with criminal damaging, a second-degree misdemeanor, and driving on a closed road, an unclassified misdemeanor.

Wagner’s bond is set at his own recognizance (OR). While his case is pending, Wagner must observe a curfew. Records add that he must “report to (the) probation (department) immediately for (a) drug screen.”

Wagner’s case is set for a pretrial in September, according to records.
