Grand jury indicts 16

A Hillsboro man charged with rape has been indicted by the August session of a Highland County grand jury.

Devin Hartley, 19, was indicted on the first-degree felony on Tuesday. According to the indictment, he allegedly “engage(d) in sexual conduct with… a juvenile” between Dec. 15, 2013 and April 20, 2014. The indictment added that the juvenile was reportedly 12 years old.

Also indicted was Roger M. Hatfield, 62, Hillsboro. The Times-Gazette previously reported that he was charged after the Hillsboro Police Department responded to a report of a gunshot last month.

Upon arrival at an apartment on North East Street, the responding officer found two females standing over a male “who had what appeared to be a gunshot wound to his upper chest/neck area,” according to the affidavit.

A second male – identified as Hatfield – was reportedly sitting across the table from the others. The officer also reported that there was “a black pistol sitting directly in front of Hatfield on the table and a spent shell casing on the floor behind him,” as stated in the affidavit.

The alleged victim was later care-flighted to Miami Valley.

On Tuesday, Hatfield was indicted on second-degree felonious assault, as well as a forfeiture specification.

Also indicted were Argentina R. Hill, 45, and James M. Rust, 44, both of Hillsboro. As previously detailed by The Times-Gazette, Hill and Rust were arrested after items used to manufacture methamphetamine were allegedly found in a vehicle.

They were each indicted Tuesday on third-degree felonies for illegal assembly or possession of chemicals for the manufacture of drugs.

Robert W. Sions, 58, Hillsboro, was also indicted. He is charged with second-degree felonies trafficking in heroin and possession of heroin, fourth-degree felony possession of cocaine, fifth-degree felony possession of cocaine, and a forfeiture specification.

The Times-Gazette previously reported that Sions waived a preliminary hearing in the Hillsboro Municipal Court last week for fifth-degree felony drug abuse. That charge is unrelated to the ones he was indicted on Tuesday.

Other individuals indicted by the August grand jury are:

• Chase Daugherty, 27, Greenfield, charged with two counts of third-degree felony abduction;

• Ryan Burton, 32, Clarksville, charged with second-degree felony illegal manufacture of drugs;

• Terry Rahn, 67, Cincinnati, charged with aggravated trafficking in drugs, a fourth-degree felony, and aggravated possession of drugs, a fifth-degree felony;

• Trenton Zumwalde, 19, Lynchburg, charged with trafficking in heroin, possession of heroin, and possession of cocaine, all fifth-degree felonies, as well as a forfeiture specification;

• Shawn Schirmer, 26, Hillsboro, charged with trafficking in marijuana, possession of heroin, and possession of cocaine, all fifth-degree felonies, as well as a forfeiture specification;

• Jennifer Piatt, 31, New Vienna, charged with fifth-degree felony aggravated possession of methamphetamine;

• William Penix, 31, Hillsboro, charged with fifth-degree felony breaking and entering;

• Donald Gadberry, 43, Hillsboro, charged with failure to register a change of address as a registered sex offender, a third-degree felony;

• Arthur Ames, 71, Dayton, charged with fourth-degree felony theft by deception and first-degree misdemeanor falsification;

• James Perkins, 19, Hillsboro, charged with two counts of fourth-degree felony domestic violence;

• Shane St. Clair, 41, Hillsboro, charged with fifth-degree felony non-support of dependents.
