A Hillsboro man is facing felony and misdemeanor charges after allegedly taking a gun and later threatening the gun’s owner.

Bennie C. Mullins, 64, is charged with third-degree felony theft and first-degree misdemeanor aggravated menacing, according to Hillsboro Municipal Court records.

An affidavit filed with the court stated that the alleged victim called the Highland County Sheriff’s Office last week. He reported that he had been “trying to help (Mullins) and get him cleaned up.”

He reportedly told the deputy that about two months ago hetook Mullins to a store in Hillsboro. When he later went to a bank he placed a Ruger .380 caliber handgun in the center console of his vehicle, as described in the affidavit.

Several days later, he reportedly went to get the gun from the console and “found that it was missing,” according to the affidavit.

The alleged victim “assumed (Mullins) had taken the gun,” the affidavit adds.

He reported that during a phone conversation Mullins allegedly “admitted to him that he borrowed the gun.”

The alleged victim reportedly told Mullins to return it. He told the deputy that he was “giving (Mullins) time to return it, but he had stopped answering his calls,” according to the affidavit.

On Oct. 28, the alleged victim reportedly went to Mullins’ home and told him “that he wanted the gun now or he would be making a police report,” the affidavit states.

Mullins then “yelled at him and told him he would ‘take care of him’ in a threatening manner,” according to the affidavit.

The alleged victim then reportedly left and called the sheriff’s office.

Mullins appeared on his charges in municipal court Wednesday. A pretrial on his misdemeanor and a preliminary hearing on his felony are both scheduled for Nov. 19, records show.

His bond is set at his own recognizance (OR). Mullins will be placed on electronic monitoring house arrest on possible probation violations. He must also report to the probation department. While his case is pending, Mullins is prohibited from having contact with the alleged victim.

In other cases, Frank W. Bryant Jr., 27, Greenfield, also appeared on a felony charge.

According to records, a warrant was issued for Bryant’s arrest when the case was first filed with the court in June.

An affidavit stated that a relative of Bryant’s came to the Hillsboro Police Department in May and reported that her bank card had been stolen from her residence. She added that “upon her checking with the bank, she found the card had been used several times without her consent,” as stated in the affidavit.

She reportedly told police that Bryant had taken the card. According to the affidavit, she had “given (him) permission in the past to use the card for small purchases.”

The affidavit added that a total of six ATM withdrawals of $200 each had been made using the card, totaling $1,200.

The officer reported that he again spoke with the alleged victim a month later. At that time, she provided a written statement saying that she had spoke with Bryant and that he “admitted to making the withdrawals and taking the bank card,” the affidavit stated.

He also told her that he burned the card, the affidavit adds.

Bryant faces a charge of fifth-degree felony theft. A preliminary hearing is scheduled for next Thursday, records show. Bryant’s bond is set at $1,000.

If he posts his bond, he will be under the supervision of the probation department. While his case is pending, Bryant is prohibited from having contact with the alleged victim. He must also observe a curfew.
