A Wilmington man appearing Monday in Hillsboro Municipal Court was found guilty of a probation violation and sentenced to jail.

According to court records, Devon Lansing, 23, was convicted of first-degree misdemeanor theft in 2013.

All but 60 days of a 180-day jail sentence was suspended. He was placed on reporting probation and ordered to perform 80 hours of community service and to pay restitution. A $1,000 fine was suspended.

Since then, a total of three warrants have been issued for Lansing, according to records. Jail time has been imposed and furloughed at different times, records add.

The Times-Gazette previously reported that when Lansing appeared last month Hillsboro Municipal Court Judge David H. McKenna said Lansing had not shown up for a previous hearing and failed to report to the probation department.

Lansing said then that he spoke with the probation department concerning complications with reporting and his work schedule. “They seemed to be OK with it,” he said.

On Monday, he appeared for a hearing and was found guilty of a probation violation. Lansing was sentenced to 40 days in jail. He was given credit for 20 days. He must return to court for a review hearing in December.

Also on Monday, Justin Smith, 22, Greenfield, appeared on a bench warrant. According to records, he was convicted of fourth-degree misdemeanor possession of drug paraphernalia in April.

A 30-day jail sentence was suspended, as was a $250 fine. He was placed on reporting probation and ordered to perform 80 hours of community service, get an assessment and any recommended counseling, and observe a curfew. His license was suspended for six months.

Records added that a warrant was issued for Smith’s arrest last month after he reportedly failed to comply with the probation department.

He was found guilty of a probation violation Monday and a 30-day jail sentence was imposed. He can be furloughed on Thursday with a negative drug screen. He must return to court in October.

In other cases, a warrant was issued for Britney Napier, 20, after she failed to appear for an arraignment.

According to an affidavit filed with the court, the alleged victim reported to the Hillsboro Police Department last week that Napier had allegedly not returned his car.

He reported that he had given her permission to use his car earlier that day to go to McDonald’s to get a tea, as stated in the affidavit.

The following day, on Aug. 13, the alleged victim made a formal report, the affidavit added. Court records showed that a warrant was issued for Napier’s arrest last Friday.

That warrant was recalled Monday and Napier was set to be arraigned on first-degree misdemeanor driving without consent, according to records. She failed to appear Monday, records added, and a $1,000 bench warrant was issued for her arrest.

In other news from the court, $7,500 bench warrants were issued for:

• Joshua Dilley, 32, Winchester, after he failed to appear for review hearings on past convictions for drug paraphernalia and drug abuse instruments. He pled no contest to the charges, according to records.

• David Zitney, 49, Leesburg, after he failed to appear for a hearing on numerous convictions, including nine counts of passing a bad check and one count of theft. Records show that he previously pled guilty to all of the respective charges.
