Sex offense lands 19-year-old in prison

A Hillsboro man was sentenced to three years in prison Thursday for a sexual offense involving a child in a hearing in Highland County Common Pleas Court.

Nineteen-year-old Devin Dakota Hartley pled guilty to an amended and reduced charge of third-degree felony gross sexual imposition.

He was charged in an August indictment with first-degree felony rape. According to that indictment, the victim was 12 years old at the time of the offense.

The state and defense jointly recommended 36 months in prison. Due to the nature of the offense, Hartley faced up to five years in prison.

Judge Rocky Coss followed the recommendation outlined in the plea agreement and noted that while Hartley had misdemeanor convictions as an adult, this was his first adult felony conviction.

Coss said the plea agreement said the state would take no position as to judicial release.

Following the completion of his prison term, Hartley will be under five years of supervision by the Adult Parole Authority. He will also be required to register as a Tier II sex offender for a 25-year period.

In another hearing, Cody Fadely, 22, Washington C.H., pled guilty to fourth-degree felony aggravated assault. An identical charge was dismissed per the plea agreement.

A year in prison was recommended in the agreement, and Coss followed that. The judge noted that Fadely had previously served a prison term.

Also sentenced on Thursday was David S. Murray, 49, of Greenfield. He pled guilty in August to fifth-degree felony aggravated possession of methamphetamine.

He was sentenced to three years community control and ordered to successfully complete treatment.
