Two sentenced to community control

A Hillsboro man sentenced to community control was among two people sentenced recently in Highland County Common Pleas Court.

Bentley Penwell, 41, was sentenced to three years of community control on one count of aggravated possession of methamphetamine, a fifth-degree felony. Penwell was also accepted into the New Way top Recovery Drug Court Docket.

The court ordered that if Penwell violates any of the community control or drug court docket sanctions, he would be given a sentence of between six and 12 months and ordered to pay a fine of $2,500.

The court also found that post-release control would be optional. If Penwell were sentenced to prison for a felony of the third degree that was not a felony of violence or a felony sex offense, or a felony of the fourth or fifth degree, after his release he would be subject to up to two years of post-release control supervision at the option of the Adult Parole Authority.

According to court documents, on or around May 7, 2023, Penwell knowingly obtained, possessed or used a Schedule II controlled substance, to wit: methamphetamine.

In other sentencings, Jesse Wheaton, 52, Greenfield, was sentenced to three years of community control on one count of aggravated trafficking in methamphetamine, a third-degree felony.

Wheaton was ordered to pay restitution through the Victim Witness Escrow Account in monthly payments of $20 beginning on June 1, 2024. He was also ordered to pay restitution of $200 to the Highland County Task Force through the Victim Restitution Escrow Account of the Highland County Victim Witness Office.

The court ordered that Wheaton must successfully complete TCC Substance Use Disorder treatment and any recommended aftercare.

The court also ordered that if Wheaton violates any of the community control sanctions, he would be given a sentence of between nine and 36 months and ordered to pay a fine of $10,000.

According to court documents, on or around Dec. 7, 2022, Wheaton knowingly sold or offered to sell methamphetamine, a Schedule II controlled substance in an amount equal to or exceeding bulk amount but less than five times the amount.
